Can older people sue for tripping and falling?

February 19, 2018 Ann Jacobs

Absolutely.

One of the things we know is that, as people age, there can be a greater risk of falls, tripping and slipping. This does not mean, however, that we require them to stay home. Instead, businesses need to recognize that older people have special needs and the business owners need to be particularly attentive towards accommodating our aging population.  When there are unexpected steps, uneven pavement, and other hazards of that nature, it’s essential that businesses be proactive to keep their property safe for all visitors, not just the young.

One of the reasons that business owners need to be especially attentive to the needs of their older visitors is that when and elderly person falls, they are more likely to be injured. While a child may stand up and brush themselves off, an older person may suffer a broken hip or worse.

Businesses that cater to an older clientele need to be particularly attentive to these sort of details.  For example, a beauty shop that has a significant older clientele may need to be extra attentive to the safety of their sidewalk and entrances.

The hazard is there for all visitors, but for an elderly person, the repercussions can be severe.
